Amodel pro bono policy for small to mid-sized firms was recently developed in New York State through the collaborative effort of Cynthia Feathers, Director of NYSBA Department of Pro Bono Affairs; Lisa Frisch, Executive Director of the Legal Project of the Capital District Women's Bar Association (Albany); Lillian Moy, Executive Director of LASNNY (Albany); David Weschler, Attorney in Charge for the Legal Aid Society (Volunteer Division, Community Law Offices Pro Bono Program of NYC); and partners from local law firms participating in a recent NYSBA law firm pro bono conference in Albany, New York.
The policy is designed to encourage and support the efforts of law firms statewide to take the lead in increasing pro bono service within the state. It recognizes that small to mid-sized firms typify statewide private practice and have different cultures and resources than large urban firms, which often have sophisticated pro bono programs and full-time pro bono coordinators.
The preface to the policy, entitled "Law Firm Pro Bono," urges that firm leaders must reinforce the message that the firm stands behind pro bono and that such services will not adversely affect attorney advancement. The benefits of pro bono, including professional development and personal satisfaction of individual attorneys and good will for the firm in the community, are also discussed. The model policy contains basic, suggested components of a law firm policy, based on a review of numerous firm policies, and it is intended to be easily adapted to fit each firm's unique needs. These components include a statement of the law firm's commitment, including an aspirational goal for service and financial contribution; a definition of pro bono; a list of the duties of a pro bono coordinator; a description of opportunities through local organized pro bono programs; and administrative procedures for pro bono cases. The model policy can be used in conjunction with a videotape on pro bono developed for the Albany conference and with presentations by local programs to law firm leaders.
