Ethical Issues in the Delivery of Legal Services

On July 24, 2003, Cynthia Works, Director of Training and Education at the National Legal Aid & Defender Association, and Toby Rothschild, General Counsel at the Legal Aid Foundation of Los Angeles, presented a workshop at the NLADA's annual Substantive Law Conference to illustrate several of the unique ethical issues that challenge legal services lawyers in their practice. The goal of this ethics training was to provide participants with resources that would aid them in dealing with the problems that characteristically arise in a legal services practice. This goal was accomplished by providing a variety of hypothetical situations intended to help participants reflect upon ethical considerations, and proceed according to the guidelines of the Rules of Professional Conduct. Areas that were covered included: confidentiality, conflicts, duty to clients, and new delivery techniques, such as self-help assistance, hotlines, and pro se representation.
